How gambling tax is calculated in 2026

Since August 2025 (Legea 141/2025), the schedule under art. 110 Codul Fiscal is: 4% for withdrawals up to 10,000 lei, 400 lei + 20% of what exceeds 10,000 lei for withdrawals between 10,001 and 66,750 lei, and 11,750 lei + 40% of what exceeds 66,750 lei for larger withdrawals. Tax is calculated on each individual withdrawal from the gaming account, not cumulated over the year — small, frequent withdrawals effectively pay less tax than one large, single withdrawal.

The 66,750 lei cap — only for casino, poker, slots and lottery tickets

These categories have a tax-free cap of 66,750 lei per withdrawal (art. 110 alin. 4 lit. b). Above this threshold, the schedule is applied to the whole amount, then a flat 11,750 lei is subtracted from the result — only the difference isn't taxed at 40%. Sports betting doesn't benefit from this cap: any amount withdrawn is fully taxed on the schedule, from the first leu.

Prizes, beyond gambling

Prizes from contests, raffles, or the workplace (other than gambling) have a separate regime: the first 600 lei of each prize are exempt, and the 10% tax applies only to the difference.

Social contributions

No type of winnings in this category is subject to CAS or CASS, regardless of the amount — an important difference from investment or rental income, where CASS is due above certain thresholds.
