How court stamp duties work
Governed by OUG 80/2013, court duties are paid in advance, into the local budget of the administrative-territorial unit where the claimant is domiciled. For claims with a monetary value, the duty is calculated on progressive brackets (Art. 3): 8% up to 500 lei (minimum 20 lei), then fixed amounts plus decreasing percentages as the value rises, down to 1% for the portion exceeding 250,000 lei.
Divorce and family claims
Divorce carries a fixed duty of 200 lei (by agreement or fault) or 50 lei (medical reasons), regardless of the value of the marital assets. Related claims — the child's residence, parental authority, maintenance/alimony — are stamped separately, usually at 20 lei each, and maintenance/alimony is often fully exempt.
Appeals and other remedies
An appeal is generally stamped at half the duty paid at first instance. An appeal for annulment (contestație în anulare) costs a fixed 100 lei, and a request for revision (cerere de revizuire) costs 100 lei for each ground of revision invoked.
Exemptions
Actions concerning employees' labor rights, maintenance/alimony, and child protection are fully exempt. Since December 2025, divorce and asset-division claims filed by victims of domestic violence against their abuser are also exempt (Law 199/2025, which supplements Art. 29 of OUG 80/2013). For people with low incomes, public legal aid (OUG 51/2008) allows an exemption, reduction or installment plan for the duty, based on proof of financial situation.
