Choose the asset type and, for stocks, the broker type — the tax regime differs radically between the two.
The two regimes for stocks, starting 2026
Since 1 January 2026 (Law 239/2025, Art. 97 para. 8¹ Cod fiscal), taxation depends on the intermediary. Through a broker that is a fiscal resident in Romania (BT Capital Partners, TradeVille, Goldring, etc.): 3% on the gain for holdings of more than 365 days inclusive, 6% for holdings under 365 days — withheld at source, a final tax, with no offsetting of losses. Through a broker with no permanent establishment in Romania (eToro, Interactive Brokers, Trading 212, Revolut): 16% on the annual net gain, which you calculate yourself through the Declarația Unică, with the advantage that losses are deducted from gains and can be carried forward for 5 years.
Cryptocurrency
16% on the gain (the positive difference between the sale price and the acquisition price, minus direct costs), regardless of the holding period. The small-amount exemption requires both conditions at once: a gain under 200 lei on each transaction and a maximum of 600 lei total per year. It's an "all or nothing" rule: if you exceed either threshold, the entire amount is taxed, not just the excess. Starting in 2026, platforms automatically report transactions to ANAF (DAC8).
CASS
If the sum of your gains and other passive income exceeds 6 minimum wages (24,300 lei), you owe CASS as a fixed amount per bracket: 2,430 / 4,860 / 9,720 lei. Technical detail: with Romanian brokers, the bracket is based on the gross gain; with foreign brokers, on the annual net gain. Gains from government bonds listed on the BVB are exempt from tax.
Since March 2026 (Emergency Ordinance 8/2026), employees can deduct from their income-tax base up to EUR 400/year invested in stocks, bonds, or ETFs through authorized intermediaries.
