Legal framework

Governed by the Cod Fiscal, Art. 474, para. 5-6. Unlike most local fees, the rate isn't set by the local council — it's fixed nationally: 0.5% for residential buildings and outbuildings, 1% for any other construction (commercial, industrial, agricultural).

The minimum floor for residential

For residential buildings, if the value declared in the permit application is lower than the building's existing taxable value (calculated under Art. 457), the fee must be calculated on the taxable value, not the declared one — an anti-underdeclaration measure.

Final regularization

The fee paid when the permit is issued is provisional, based on the declared value. Within 15 days of completing the works, you file a declaration with the actual value, and the city hall recalculates — if you spent more than you initially declared, you pay the difference.
